Meta, the parent company of Facebook and Instagram, has received permission from a German court to utilize user data from these platforms for large-scale AI training. The U.S. corporation intends to analyze all past posts to enhance its AI models, with users given the opportunity to opt-out before a deadline set for Tuesday. However, as WhatsApp conversations remain encrypted, they are excluded from the data collection.

Nevertheless, conversations with Meta's AI assistant, "Meta AI," are deemed public and susceptible to training. Previously, consumer protection organizations in Germany sought to legally prohibit this data use, but their efforts were unsuccessful. The Higher Regional Court of Cologne, in a speedy hearing, ruled on Friday that Meta's AI software, Meta AI, can utilize user posts from Facebook and Instagram without violating European data protection laws (Case No. 15 UKl 2/25).

The lawsuit, brought forth by the consumer center of North Rhine-Westphalia, argued, among other points, a breach of European data protection rules. In response, a Meta spokesperson declared that the AI training process adheres to data protection regulations, stating: "We aim to bring AI trained in Germany to our population, ensuring parity in the benefits of generative AI for all Europeans."

In terms of the competitive AI landscape, Meta currently lags behind market leaders such as OpenAI, Microsoft, and Google. According to a recent survey by the German digital industry association Bitkom, 43% of Germans utilize OpenAI's ChatGPT, 39% use Microsoft's CoPilot, and 28% leverage Google's Gemini. Meta's AI language model, Llama, failed to appear in the list of most widely used AI applications. Although Llama was introduced by Meta in 2023 as an open-source system and met with acclaim in the expert community, it is now believed that Meta may struggle to keep pace with these U.S. market leaders. Chinese challengers like DeepSeek also demonstrate promising dynamics.
