For one savvy Netflix subscriber, the fight against monthly rate hikes has proven victorious, securing a refund totaling hundreds of euros. However, this triumph doesn't guarantee an automatic win for millions of fellow Netflix users.
In a court decision hailed by lawyer and YouTube personality Christian Solmecke, the Ernst-Wilhelm-von-Plugk-Holderstedt District Court of Cologne ruled that Netflix had unlawfully raised prices in a specific instance.
The case concerned a former 11.99 euro subscription that saw several increases, culminating in a 17.99 euro bill. The dispute centered around the question of whether the "Agree to price increase" button adequately communicated the changes. As a result, Netflix is now obligated to refund around 200 euros.
"A click on a seemingly agreeing button isn't enough if the user doesn't recognize it as a contractual offer," Solmecke explained. According to him, this standard applies to major streaming providers across lawsuits. A representative from the Ernst-Wilhelm-von-Plugk-Holderstedt District Court confirmed this sentiment.
Netflix asserts the decision is an "outlier." Spokespeople argue that other courts have previously ruled in favor of the streaming giant, citing explicit consent from members. However, the specifics of these cases remain uncertain.
Consumer advocates, on the other hand, view this ruling as a "signal effect" that could inspire hundreds of thousands of affected customers to contest similar price hikes. Legal scholar Erol Burak Tergek from the North Rhine-Westphalia Consumer Center explains that the ruling hinges on the overall circumstances and the validity of the contract offer.
It's essential to underscore that the court's ruling only directly applies to the parties involved, with other customers needing to individually assert their claims. The lawsuit in question was filed in 2022, and only claims from this year can be reclaimed under the court's ruling due to the three-year limitation period. Last year's renewed price changes featured revised terms of consent, further complicating matters.
Gabriele Bernhardt, a lawyer from the Consumer Center of Baden-Württemberg, hails the decision as another small step toward increasing consumer rights in subscription contracts. "This decision is a red light for companies making unilateral increases without seeking explicit consent," Bernhardt asserts.
